Trim Tax

Real Estate Tax Planning for Landlords, Investors and Realtors

Rental income, property sales, flips, pre-construction assignments, HST rebates and holding-company structures — Trim Tax makes sure real estate builds your wealth instead of your tax bill.

Real estate is where tax mistakes get expensive

Property transactions involve large numbers and detailed rules: the principal residence exemption and its designation requirements, the property-flipping rule that treats gains on residential properties held under 365 days as fully taxable business income, GST/HST on new and substantially renovated homes, assignment sales, the Underused Housing Tax, non-resident withholding, and the distinction between a repair (deductible now) and an improvement (capitalised).

A single missed designation or rebate can cost tens of thousands of dollars. Trim Tax's CPAs advise before you buy, sell or restructure — and prepare every return, election and rebate afterwards.

Landlords, flippers and realtors have different problems

A landlord needs a correct T776 each year, an adjusted cost base that captures every capitalised improvement, and a decision each year on whether to claim capital cost allowance. A flipper or pre-construction assignor needs to know before closing whether the gain will be a capital gain or business income and whether HST applies to the assignment.

A real estate agent needs a Personal Real Estate Corporation set up and maintained properly, commission income and marketing expenses reported correctly and HST on commissions reconciled. We serve all three, and investors moving between them, from a single practice.

Frequently asked questions

Capital gains are partially included in income at the current inclusion rate, after selling costs and adjusted cost base. If the CRA views the activity as a business — frequent flips, a sale within 365 days without a qualifying exception, or a property bought with intent to resell — the full gain is taxable as business income and no principal residence exemption is available.
Partially, depending on the years it was your principal residence, whether you filed a 45(2) or 45(3) change-in-use election, and whether you claimed CCA. The designation must be reported on Schedule 3 and T2091 in the year of sale; an unreported sale can lose the exemption and attract penalties.
Long-term residential rent is exempt. Short-term rentals (under 30 continuous days) and commercial rent are generally taxable once you exceed the small-supplier threshold, and converting a property between uses can trigger self-supply or ITC recapture rules.
A federal 1% annual tax on the value of vacant or underused residential property owned by certain non-residents, and in some years by Canadian corporations, partnerships and trusts. Many affected owners must file a UHT return by April 30 even if an exemption means no tax is owed, and non-filing penalties are substantial.
It depends on liability, estate planning, income splitting, financing and refinancing goals. Passive rental income in a corporation is taxed at high rates and can grind the small business deduction of an operating company, so the answer is not always yes. We model it with you.
Since May 2022, assignment sales of new residential housing are generally taxable for HST purposes regardless of the assignor's intent. We calculate the HST and the income tax treatment before you assign.
