Final Returns, Estate and Trust Filings — Handled With Care

Executors and trustees rely on Trim Tax to prepare final returns, estate T3s and clearance certificates correctly, so the estate can be settled without CRA delays or personal liability.

Support for executors, trustees and families

Settling an estate means dealing with the CRA at a difficult time. The deceased's final T1 must report income to the date of death and the deemed disposition of capital property; optional returns can reduce the overall tax; the estate itself becomes a trust that files T3 returns until it is wound up; and the clearance certificate that protects the executor from personal liability cannot be requested until everything else is done.

Each step has rules and deadlines, and mistakes fall on the executor personally. Trim Tax handles the full sequence, coordinates with the estate lawyer, and explains each step in plain language.

Trusts now have annual filing obligations

Since the 2023 taxation year, most express trusts — family trusts, alter-ego and joint partner trusts, testamentary trusts and many bare trust arrangements — must file an annual T3 return with Schedule 15 beneficial ownership information, even when they have no income and would not previously have filed.

Penalties for non-filing are significant. Trim Tax reviews whether your trust is affected, prepares the returns and maintains the beneficial ownership schedule year to year.

Frequently asked questions

If death occurred between January 1 and October 31, the final return is due April 30 of the following year (June 15 if the deceased or spouse was self-employed); if death occurred between November 1 and December 31, it is due six months after the date of death. Any balance is due at the same time.
It is the CRA's confirmation that all taxes of the deceased and the estate have been paid or secured. Executors who distribute assets without one can be held personally liable for any unpaid tax up to the value distributed. We request it once the final T1, optional returns and estate T3s are assessed.
Usually yes. Income earned by the estate after death — interest, dividends, rental income, gains on sale of estate assets — is reported on a T3 trust return. Designating the estate as a Graduated Rate Estate allows graduated tax rates for up to 36 months and access to certain elections.
The full value is included in income on the final return unless it is rolled over to a spouse, common-law partner or financially dependent child or grandchild. We prepare the rollover elections and the T4RSP/T4RIF reconciliation.
Under the trust reporting rules effective for 2023 and later years, most express trusts must file a T3 with Schedule 15 every year regardless of income, unless an exemption applies (for example, trusts holding less than $50,000 in certain assets throughout the year). We confirm your trust's status.
Yes. A pre-bankruptcy return covers January 1 to the day before bankruptcy and a post-bankruptcy return covers the remainder of the year; we prepare both in coordination with the licensed insolvency trustee.
